3. Purpose and Activity

Trueku is an online intermediation platform that facilitates the exchange of goods between individuals without monetary consideration (barter or swap). The provider acts exclusively as an intermediary and is not a party to any exchange carried out between users.

4. Intellectual and Industrial Property

The source code, design, brand, logos and other creative elements of the Platform are owned by the provider or have been duly licensed, and are protected by applicable intellectual and industrial property law. Reproduction, distribution or public communication without express authorisation is prohibited.

Users retain all rights over the content they publish and grant the provider only the licence of use described in the Terms and Conditions.

5. Liability

The provider does not guarantee uninterrupted availability of the Platform and is not liable for damages arising from service interruptions caused by factors beyond its control. The provider is also not responsible for content published by users, without prejudice to its obligation to act with due diligence upon becoming aware of illegal content, in accordance with Regulation (EU) 2022/2065 on Digital Services (DSA).

6. Applicable Law

This Legal Notice is governed by directly applicable European Union law and, to the extent not covered by it, by the law of the country in which Trueku has its principal place of business. Notwithstanding the foregoing, EU users may bring proceedings before the courts of their place of domicile in accordance with the Brussels I bis Regulation.
